Pensioners Demand Implementation of Federal Court Decision on Pensions Adjustment: Report

A former Wisma Putra civil servant, Aminah Ahmad, representing 56 other pensioners, has issued a demand to the Malaysian government to enforce a Federal Court decision. The court declared the amendment to Sections 3 and 7 of the Pensions Adjustment (Amendment) 2013 Act null and void, which allowed for a 2% annual increment in pensions.

In the letter of demand, issued on October 6, Aminah Ahmad’s legal representation gave the government 21 days to implement the court’s decision. The demand was directed to key government officials, including the Chief Secretary to the Government, the director-general of the Public Services Department, and the director of Pensions.
The law firm representing the pensioners emphasized that the government and its agencies have a duty to respect the rule of law and uphold the court’s judgment. Failure to do so, they argue, would be unjust to pensioners who are entitled to the benefits of their labor.

These pensioners, many in the later years of their lives, are seeking the arrears entitled to them from the Court of Appeal’s decision made on January 13, 2022. The Federal Court had previously upheld the Court of Appeal’s decision, deeming the 2013 amendment unconstitutional and reverting to the pre-2013 mechanism for pensions.
Prime Minister Datuk Seri Anwar Ibrahim announced that pensions for July to December 2023 would return to the pre-2013 mechanism following the Federal Court’s decision.

The pensioners’ demand highlights the importance of upholding the rule of law and protecting the rights of retirees who have served the nation through their public service careers.
